Please read these Terms and Conditions carefully before using the Travel Smarter platform. By creating an account or using any part of Travel Smarter, you agree to be bound by these Terms. If you do not agree, you must not use the platform.
1. Definitions
In these Terms and Conditions:
- "Travel Smarter", "we", "us", "our" means TravelSmarter Ltd, a company registered in England and Wales under company number 16629769, with its registered office at Suite J, Athene House, 86 The Broadway, Mill Hill, London NW7 3TD.
- "Platform" means the Travel Smarter website, web application, mobile applications, and any associated tools, APIs, or features we make available.
- "User", "you", "your" means any individual who accesses or uses the Platform.
- "Subscription" means a paid plan (Premium or Pro) granting access to additional features of the Platform.
- "Content" means all data, calculations, recommendations, text, and information provided through the Platform.
- "Partner" means any airline, hotel, hotel group, travel agency, online travel agency (OTA), card issuer, or other third party with whom Travel Smarter has a referral, affiliate, or data-sharing arrangement.
2. Eligibility
You must be at least 18 years of age to create an account and use the Travel Smarter Platform. By registering, you confirm that you are 18 or older and that you have the legal capacity to enter into a binding contract.
We require users to be 18 or over because: (a) our Subscription terms create binding contractual obligations that minors cannot enter into in England and Wales other than for necessaries; (b) our payment processors require account holders to be 18 or over; and (c) the airline and hotel loyalty programmes our service supports generally require members to be 18 or over. If we become aware that an account has been opened by a person under 18, we reserve the right to suspend or terminate that account and cancel any Subscription without refund.
3. Description of Service
Travel Smarter is an informational optimisation platform. The Platform helps you understand and make decisions about loyalty programmes by providing estimates, recommendations, and progress tracking based on publicly available information about airline, hotel, and card-issuer loyalty programmes and on information you provide to us.
Travel Smarter does not sell travel, hold bookings, or act as a travel agent. Any booking, purchase, or redemption of points, miles, or rewards is transacted directly between you and the relevant airline, hotel, travel agency, online travel agency, or card issuer, under that third party's own terms, on that third party's own website or platform.
You acknowledge and agree that Travel Smarter does not guarantee any outcome, including (without limitation): (i) the award or crediting of any specific number of points, miles, or Tier Points; (ii) the availability of any award seat, upgrade, or hotel redemption; (iii) qualification for, or maintenance of, any elite or loyalty status; (iv) the monetary value of any points or rewards; (v) the price, terms, or availability of any offer presented by a Partner; or (vi) the absence of changes to any loyalty programme's rules, earning rates, partner arrangements, or redemption charts.
4. Subscription and Billing
Travel Smarter offers three plan tiers: Free, Premium, and Pro. Paid Subscriptions (Premium and Pro) are billed annually in advance. The features included in each tier are described on our pricing page and may be updated from time to time.
4.1 Billing
Payment is taken at the point of Subscription and at each annual renewal date. You will receive advance notice by email before each renewal in accordance with applicable consumer law.
4.2 Price changes
Travel Smarter reserves the right to change Subscription pricing. You will be given at least 30 days’ written notice before any price change takes effect on your account. If you do not wish to accept the new price, you may cancel in accordance with Section 5 before the new price takes effect.
4.3 Failed payments
If a payment fails, access to paid features may be suspended until payment is successfully processed. You will be notified by email and given a reasonable opportunity to update your payment details.
4.4 Promotional codes
Discount codes (e.g. FASTRACK50) are valid for the initial Subscription period only unless otherwise stated, and cannot be applied retrospectively to Subscriptions already paid for.
5. Cancellation and Refunds
You may cancel your Travel Smarter Subscription at any time by navigating to Settings → Subscription within the Platform, or by contacting us at info@travel-smarter.com.
5.1 Effect of cancellation
Upon cancellation, your Subscription will not renew at the end of the current billing period. You will retain access to paid features until the end of the period you have already paid for, and your account will revert to the Free plan thereafter.
5.2 No refund for unused portion
Except where required by law, Travel Smarter does not provide refunds for the unused portion of a paid Subscription after the statutory cooling-off period (Section 5.3) has ended. Your Subscription will continue to provide paid-feature access through to the end of the period you have paid for.
5.3 Statutory cooling-off right (new subscribers)
If you are a consumer resident in the United Kingdom, you have the right to cancel your Subscription within 14 days of purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and to receive a full refund. By accessing paid features during the 14-day period, you expressly request that we begin supplying the Subscription service immediately and acknowledge that you will lose the right to cancel once the service has been fully supplied. If you cancel during the 14-day period after having used the service, we may deduct an amount proportionate to the service used before cancellation.
5.4 Free plan
The Free plan carries no charge and is not subject to refund provisions.
5A. Commission and Affiliate Disclosure
Travel Smarter may receive commission, referral fees, or other compensation from Partners (including airlines, hotels, travel agencies, online travel agencies, and card issuers) when you click through from the Platform to a Partner's website and subsequently complete a booking, sign up, or other qualifying action.
Commission does not influence which offers or Partners we show you. Recommendations presented on the Platform are generated on the basis of factors such as points valuation, upgrade probability, fare class, award availability, and your stated loyalty and travel preferences. We do not adjust ranking, placement, or filtering of recommendations on the basis of commercial arrangements with any Partner.
Where a specific link or recommendation is commercially sponsored (as distinct from an organic recommendation earning only standard referral commission), that link will be clearly marked as sponsored in-product.
6. Points Calculations and Recommendations — Disclaimer
Travel Smarter provides estimates of loyalty points, miles, Tier Points, and related earning figures based on publicly available airline, hotel, and loyalty programme information. These calculations are produced and maintained by Travel Smarter's internal logic team, who research earning rules, fare family multipliers, cabin class rates, status bonuses, and partner earning tables for each supported programme.
By using the Platform's calculation and recommendation features, you acknowledge and agree that:
- All points calculations, valuations, and recommendations are estimates only. They are not guaranteed to match the exact figure credited by any airline, hotel, or loyalty programme, or the outcome of any booking.
- Discrepancies may arise due to tax and fee variations, airport-specific levies, partner earning-rate changes, promotional multipliers, fare class reclassification, rounding logic applied by individual programmes, and other factors outside our control.
- Travel Smarter is not affiliated with, endorsed by, sponsored by, or acting on behalf of any airline, hotel, hotel group, loyalty programme, alliance (including without limitation Oneworld, SkyTeam, and Star Alliance), card issuer, or financial institution. References to any such entity are for informational and identification purposes only and do not imply any partnership, endorsement, or authorised representation.
- Earning rules, redemption charts, elite qualification thresholds, and partner arrangements published by airlines, hotels, and loyalty programmes may change at any time, with or without notice. Travel Smarter endeavours to keep its calculation logic current but cannot guarantee real-time accuracy, and is not responsible for programme changes or their effects on your points, status, or travel plans.
- Award availability, upgrade availability, cabin availability, and promotional offers are controlled entirely by the relevant airline, hotel, or Partner and are subject to their inventory management, yield controls, blackout dates, and capacity. Travel Smarter has no control over, and makes no representation regarding, the availability of any specific award, upgrade, fare, or room.
- The monetary value of points, miles, and rewards fluctuates and is not fixed. Any valuation shown on the Platform is a reference estimate only, based on Travel Smarter’s internal methodology, and should not be relied upon as a guaranteed or realisable value.
- Travel disruption (including cancellations, delays, schedule changes, denied boarding, overbooking, equipment changes, and force majeure events) is a matter between you and the operating airline, hotel, or service provider. Travel Smarter has no liability for such disruption or its consequences, including any effect on points earnings, status qualification, or the value of rewards.
- Your loyalty-programme account is governed by your contract with the relevant programme operator. Travel Smarter is not responsible if a programme operator suspends, restricts, closes, or forfeits the contents of your account. We do not operate any such account on your behalf and do not have authority to dispute any programme decision.
- You should always verify final points earnings, award availability, upgrade eligibility, and elite qualification directly with your airline, hotel, or loyalty programme before making any travel, financial, or other decision in reliance on Travel Smarter estimates.
7. Third-Party Integrations and Accounts
The Platform enables you to enter, and in some cases connect, information from third-party loyalty programmes, airline accounts, hotel accounts, card issuer accounts, and other Partner services. You are solely responsible for:
- Ensuring that your use of the Platform, including any account connection or data input, complies with the terms and conditions of each third-party programme or service;
- Ensuring you have the right to enter, share, or connect any information you submit to the Platform, including loyalty-programme membership numbers;
- The accuracy, completeness, and currency of the information you provide, and for updating it when it changes;
- Keeping your third-party account credentials secure. You must not share account credentials for third-party programmes with Travel Smarter except through supported, secure account-connection mechanisms we provide.
Travel Smarter does not control third-party programmes, services, websites, or platforms. We are not responsible for their content, availability, accuracy, security, or the consequences of your interaction with them, including any account suspension, points forfeiture, or contractual dispute arising out of your relationship with the third party.
8. User-Generated Data and Accuracy Responsibility
You are responsible for the accuracy of the information you provide to Travel Smarter, including (without limitation) travel history, flight records, points balances, loyalty-programme membership details, and travel preferences. The usefulness of the recommendations and estimates we provide depends on the quality of the information you give us.
Travel Smarter does not verify the information you enter. We are not liable for any inaccuracy, loss, or adverse consequence arising from information that is incorrect, incomplete, outdated, or misrepresented, whether provided deliberately or by mistake.
9. Acceptable Use
These rules exist to protect the integrity of the Platform, the value of the work that goes into our calculation logic and loyalty database, and the experience of other users. By using Travel Smarter, you agree that you will not:
- Break the law. Use the Platform for any unlawful purpose, or in violation of any applicable laws or regulations.
- Hack the Platform. Attempt to gain unauthorised access to any part of the Platform, our servers, our databases, our APIs, or any connected systems.
- Scrape or copy our database. Scrape, copy, reproduce, redistribute, sell, licence, or make available any Content from the Platform — including our compiled loyalty programme rules, earning tables, valuations, or recommendations — without our prior written consent. Our compiled database represents substantial investment and is protected by UK database right.
- Run bots or automation. Use automated tools, bots, crawlers, or scripts to access or interact with the Platform in any way not intended for normal user operation.
- Submit false information. Submit false, misleading, or fraudulent information to the Platform, including incorrect loyalty-programme membership details or fabricated travel records. The Platform's recommendations depend on accurate data and false data degrades the service for everyone.
- Disrupt the Platform. Use the Platform in any way that could damage, disable, overburden, or impair its operation, or interfere with other users' access.
- Reverse engineer the service. Attempt to reverse engineer, decompile, disassemble, or extract the source code, database structure, or underlying logic of the Platform, including for the purpose of building a competing product.
- Abuse loyalty programmes. Use the Platform to engage in any activity that violates the terms of any third-party loyalty programme, including manufactured spend, fraudulent booking, account cycling, or abuse of promotional offers.
- Use someone else's account. Use another person's loyalty-programme account, or submit another person's personal information to the Platform, without their informed consent.
- Build a competing product on top of us. Use the Platform, our Content, or our outputs to build, train, or improve any competing product, machine-learning model, or service.
Travel Smarter reserves the right to suspend or terminate any account that breaches these rules, and, where the breach is serious, to do so without prior notice and without refund.
10. Intellectual Property
10.1 Our IP
All Content on the Travel Smarter Platform — including (without limitation) the calculation logic, data models, algorithms, compiled databases of loyalty programme rules and earning tables, user interface design, text, graphics, branding, and trade marks — is the intellectual property of TravelSmarter Ltd or its licensors. This Content is protected by copyright, by UK database right under the Copyright and Rights in Databases Regulations 1997 (which protects our compiled loyalty database as a substantial investment), by unregistered design right, by the law of confidence, and by other applicable intellectual property laws.
10.2 Your licence to use the Platform
Your Subscription grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your own personal, non-commercial purposes, in accordance with these Terms. You may not copy, reproduce, modify, distribute, publish, publicly display, sell, licence, or create derivative works from any Content on the Platform without the express written permission of TravelSmarter Ltd.
10.3 Third-party trade marks
Airline names, hotel names, loyalty programme names, alliance names (including Oneworld, SkyTeam, and Star Alliance), card issuer names, and associated trade marks referenced on the Platform remain the property of their respective owners. Their appearance on Travel Smarter does not imply any affiliation, sponsorship, or endorsement, and is permitted under applicable fair-use principles for identification purposes only.
10.4 Information you submit to the Platform
You retain ownership of the information you submit to the Platform (such as your travel history, loyalty-programme details, points balances, and preferences). By submitting information to the Platform, you grant TravelSmarter Ltd a worldwide, royalty-free, non-exclusive licence to use, store, process, reproduce, and adapt that information for the following purposes: (a) operating the Platform and providing the service to you; (b) sharing your information with Partners where you have given consent under Section 15.4; and (c) creating anonymised and aggregated data sets that cannot reasonably be used to identify you, for the purposes of improving the Platform, conducting analytics, and producing industry insights.
This licence continues for as long as the relevant information remains in our systems in accordance with our retention policy (Section 15.6). Anonymised and aggregated data, by its nature, may continue to be used after your account is closed.
11. Disclaimers
To the fullest extent permitted by law, and subject always to Section 12.4:
- Travel Smarter provides the Platform on an "as is" and "as available" basis. We make no warranties, conditions, representations, or undertakings — express or implied, statutory or otherwise — regarding the Platform or any Content, including (without limitation) warranties of accuracy, completeness, currency, fitness for a particular purpose, non-infringement, merchantability, or uninterrupted availability.
- We do not warrant that the Platform will be error-free, secure, uninterrupted, or free from viruses or harmful components.
- We make no representation or warranty regarding the financial, commercial, or travel value of points, miles, elite status, or any reward, nor regarding any outcome that you may hope to achieve by using the Platform.
- Recommendations, estimates, valuations, and other Content are not financial advice, investment advice, travel agency advice, or professional advice of any kind. You are solely responsible for any decision you make in reliance on the Platform.
12. Limitation of Liability
12.1 Exclusion of indirect loss
To the fullest extent permitted by law, TravelSmarter Ltd shall not be liable to you for any indirect, incidental, consequential, special, punitive, or exemplary damages, including (without limitation) loss of profit, loss of revenue, loss of business, loss of opportunity, loss of goodwill, loss of anticipated savings, or loss of data, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, and whether or not foreseeable.
12.2 Loyalty-related losses
Without limiting the generality of Section 12.1, TravelSmarter Ltd shall not be liable for any loss of (or failure to earn or retain) loyalty points, miles, Tier Points, elite status, upgrades, award availability, promotional bonuses, or the monetary or travel value of any of them, arising out of or in connection with your use of the Platform, any Content, any recommendation, or any subsequent interaction with a Partner.
12.3 Liability cap
Subject to Section 12.4, our total aggregate liability to you in connection with these Terms and the Platform, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the greater of (a) the total Subscription fees paid by you to TravelSmarter Ltd in the 12 months immediately preceding the event giving rise to the claim, and (b) £100.
12.4 Liability that cannot be excluded
Nothing in these Terms excludes or limits our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any other liability that cannot be excluded or limited under English law, including your statutory rights as a consumer under the Consumer Rights Act 2015.
13. Indemnification
You agree to indemnify, defend, and hold harmless TravelSmarter Ltd, its directors, officers, employees, contractors, and agents from and against any third-party claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of the Platform or any Content; (c) your violation of the terms of any third-party loyalty programme, airline, hotel, travel agency, OTA, or card issuer; (d) your infringement of any intellectual property right or other right of any third party; or (e) any information you submit to the Platform that is false, misleading, or misappropriated.
14. Termination
You may terminate your account at any time by cancelling in accordance with Section 5 and deleting your account through the Platform settings or by contacting us.
We may suspend or terminate your access to the Platform, with or without notice, if: (a) you breach these Terms; (b) we reasonably suspect fraudulent, unlawful, or abusive conduct; (c) continued provision of the service to you would expose us to legal, regulatory, or reputational risk; or (d) we cease to offer the Platform or the relevant Subscription tier.
On termination: (i) your licence to access the Platform ends; (ii) any outstanding Subscription fees for the current billing period remain payable and non-refundable, except as required by law or Section 5.3; (iii) provisions which by their nature are intended to survive termination (including Sections 5A, 10, 11, 12, 13, 15, and 16) will continue in force.
15. Data Privacy
TravelSmarter Ltd is the data controller for personal data processed through the Platform. We are committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
15.1 Data we collect
We collect:
- Account data: name, email address, password (hashed), and account preferences.
- Loyalty and travel data: loyalty-programme memberships, points and miles balances, elite-status information, flight and stay records, travel preferences, and any other information you enter into the Platform.
- Payment data: processed by our payment processor; we do not store full card numbers on our systems.
- Usage data: log data, device and browser information, IP address, pages viewed, features used, and interaction events, used to operate, secure, and improve the Platform.
15.2 How we use your data
We use your personal data to:
- Provide the Platform, generate recommendations, calculate points and valuations, track your loyalty progress, and personalise the service;
- Process Subscription payments and manage billing;
- Send service-related communications (account notices, security alerts, Subscription confirmations, material changes to these Terms);
- Send optional marketing communications where you have opted in;
- Understand how the Platform is used, identify bugs and abuse, and improve our service;
- Comply with legal, regulatory, and tax obligations.
15.3 Lawful bases for processing
We rely on the following lawful bases under Article 6 UK GDPR:
- Performance of a contract (Article 6(1)(b)) — to provide the Platform to you under these Terms, including processing your loyalty and travel data to generate recommendations you have asked for.
- Legitimate interests (Article 6(1)(f)) — to operate, secure, and improve the Platform, prevent fraud and abuse, and carry out analytics on aggregate usage.
- Consent (Article 6(1)(a)) — for optional marketing communications, for sharing your data with Partners when you act on a booking referral (Section 15.4), and for non-essential cookies (Section 15.7). You can withdraw consent at any time without affecting the lawfulness of processing before withdrawal.
- Legal obligation (Article 6(1)(c)) — to comply with accounting, tax, and regulatory record-keeping requirements.
15.4 Sharing your data with Partners (booking referrals)
When you decide to act on a recommendation and proceed to book with a Partner (an airline, hotel, hotel group, travel agency, online travel agency, or card issuer), we will ask you in a separate, specific consent prompt whether you agree to share your relevant information with that Partner so that the Partner can present and facilitate the offer.
If you give consent, we may share the minimum information necessary for the Partner to present the offer, which may include your name, contact details, relevant loyalty-programme number, travel dates, preferences, and Platform-generated recommendation details.
Important: once your information is shared with a Partner with your consent, the Partner becomes an independent data controller in respect of that information. The Partner will process your information under its own privacy policy, which we encourage you to review before giving consent. Travel Smarter is not responsible for the Partner's data-handling practices.
You are not required to give this consent. If you decline, you can still use the Platform; you will simply need to interact with the Partner directly without our introduction, and the offer presented may differ from one a Partner could have tailored to you.
You can withdraw consent for future sharing at any time through your account settings or by contacting us. Withdrawal does not affect data the Partner already holds; to exercise rights against the Partner, you will need to contact the Partner directly.
15.5 Other recipients of your data
We may also share your personal data with:
- Service providers acting as processors on our behalf (cloud hosting, email delivery, payment processing, analytics, customer support), under written agreements that require them to protect your data and use it only for the purposes we have specified;
- Professional advisers (lawyers, accountants, auditors) where necessary;
- Law enforcement, regulators, and courts, where we are legally required or permitted to do so;
- A purchaser or successor entity in connection with a merger, acquisition, corporate restructuring, or sale of assets, subject to appropriate confidentiality undertakings.
15.6 Data retention
We retain your personal data for as long as your account is active. On account closure, we retain your data for a further 24 months for fraud prevention, dispute resolution, and to reinstate your account if you choose to return. We retain financial and tax records for 6 years as required by HMRC, and any other records for longer periods only where we are legally required to do so. After these retention periods we will delete or anonymise your data.
15.7 Cookies and tracking technologies
Travel Smarter uses cookies and similar technologies to operate the Platform (strictly necessary), remember your preferences (functional), measure usage (analytics), and — where you consent — to deliver relevant marketing. You can manage your preferences at any time via the cookie settings banner on the Platform or in your account settings. Details of the specific cookies used are set out in our Cookie Policy at /cookies.
15.8 International data transfers
Where we transfer your personal data outside the United Kingdom, we do so in accordance with UK GDPR requirements, relying on adequacy decisions where available and, where not, on appropriate safeguards such as the UK International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses, or other lawful transfer mechanisms.
15.9 Security
We implement appropriate technical and organisational measures to protect your personal data, including encryption in transit, access controls, hashed password storage, logging and monitoring, secure development practices, and vendor due diligence. No internet-connected system is completely secure, and we cannot guarantee absolute security.
15.10 Your rights
Under UK GDPR you have the right to: access your personal data; rectify inaccurate data; request erasure (the "right to be forgotten") in certain circumstances; restrict processing; object to processing based on legitimate interests or direct marketing; receive your data in a portable format; and withdraw consent at any time. To exercise any of these rights, contact us at info@travel-smarter.com. We aim to respond within one month.
You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk or 0303 123 1113.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date. Material changes will take effect no sooner than 30 days after notice, except where a shorter period is necessary for legal or security reasons. Your continued use of the Platform after material changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and may cancel in accordance with Section 5.
17. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that if you are a consumer resident in another part of the United Kingdom, you may also bring proceedings in the courts of your home jurisdiction.
Before initiating any formal dispute, we encourage you to contact us at info@travel-smarter.com so we can attempt to resolve the matter informally.
18. General
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms to a successor entity on notice to you. These Terms, together with our Privacy Policy and any other documents expressly referenced, constitute the entire agreement between you and TravelSmarter Ltd in relation to the Platform.
